Terms of use

1. Scope and roles

These Terms of Use govern the Einmalfilm event service on einmalfilm.online, operated by COLD3 UG (haftungsbeschränkt), Speditionsstraße 15a, 40221 Düsseldorf, Germany; support@einmalfilm.com. The person who uses a valid code to create an event is its event creator and, automatically, its first confirmed participant. A guest who later joins is a participant only. Both can capture moments under the same per-person allowance. A person who merely visits a page, receives a link or appears in a photo does not become a participant or agree to these Terms merely for that reason.

2. Code, creation and final event choices

A valid, active and unused code can create one event for its stated participant limit. Checking a code does not redeem it; successful event creation does. The creator enters the event details, chooses a duration of one to 48 hours and selects who receives the archive link: 'Only me' (the creator alone) or 'All participants' (the creator and all confirmed participants). The creator counts towards the package limit. Once the event is created, its code has been used and its settings and recipient choice cannot be changed through the ordinary flow. Purchasing a code, payment, refunds and withdrawal are covered by the separate documents on einmalfilm.com; this event confirmation is not a declaration waiving consumer withdrawal rights.

3. Inviting guests and using personal links

The creator may share the event invitation link or QR code with intended guests and should explain the event and chosen archive audience to them before participation. A guest registers with an email address and must activate the personal link within the time shown in the registration flow. A confirmed guest receives one participant place and their personal camera access for the event. Camera links are individual; do not share them. The invitation link and the common archive link have different purposes. Keep codes and private links secure and contact support@einmalfilm.com if they are exposed or misused.

4. Moments and product boundaries

Every confirmed participant, including the creator, may capture up to 25 successfully stored moments. A failed upload should not consume a moment. Moments are not displayed in a public live gallery. After the event ends and processing finishes, one shared private ZIP archive is prepared from the stored moments. It is available for download until seven days after the event ends. This is a temporary event archive, not a permanent photo storage service. Recipients should keep their own lawful copies after receiving the archive.

5. Photography, rights and participant duties

The creator is responsible for choosing the event context and informing invitees that event photography and a shared archive are planned, including who is selected to receive the archive link. Each participant, including the creator when taking photos, is responsible for what they photograph or submit. Respect venue rules and the rights and wishes of other people; do not capture or submit intimate, abusive, unlawful or rights-infringing material. Take particular care where children or people who have not joined are present. The photographer must ensure that creating and sharing each photo is lawful in the relevant circumstances. A private archive or acceptance of these Terms is not blanket permission to photograph or distribute images of other people.

You retain any rights you have in your own photos. By uploading, you give us the limited permission needed to store, process and place your photos in this event's archive and to make the archive available to the creator's chosen recipients under these Terms. You must have the rights needed to grant that permission. This does not give Einmalfilm a right to use event photos for advertising or public display. Receiving the archive does not give a recipient permission to publish its photos elsewhere; recipients must respect photographers' and depicted people's rights and any applicable local rules.

6. Archive recipients and further sharing

'Only me' means the archive link is initially sent only to the creator, who is also a participant. 'All participants' means it is initially sent to the creator and every other confirmed participant. The selection concerns delivery of the link; anyone who later receives the shared link may be able to download the ZIP. The creator chooses the initial audience, and anyone who forwards the link is responsible for that decision. Keep it private. Do not assume that a link can be recalled after a recipient has downloaded the archive. No selection makes every photograph automatically lawful.

7. People who have not agreed and reports

A person pictured in a photo, a bystander or a recipient of a forwarded link is not bound by these Terms unless they independently agree to them. Neither the creator nor participants can consent on someone else's behalf merely by using Einmalfilm. If you believe an image or event link violates your rights, contact support@einmalfilm.com with enough detail to identify the event or image. We will review reports and take appropriate measures available to us, including limiting access where possible. We cannot remove copies already saved on other people's devices. We may act to address unlawful content, misuse or security issues, subject to applicable law and the rights of those affected.

8. Privacy and service providers

The separate Privacy Policy at https://einmalfilm.online/en/privacy explains the processing of visitor information, creator and guest email addresses, photos, access links and archived media. By participating you acknowledge that information and accept these Terms; this is not, by itself, consent for any photo of your own image or permission to photograph others. The creator should direct invitees to the event information and this policy before inviting them to join.

9. Availability, problems and mandatory rights

We aim to provide the described event and archive functions, but technical failures can occur. Tell us promptly if an activation email, camera upload or archive does not work as expected. Nothing in these Terms excludes statutory remedies, applicable data protection rights or liability that cannot lawfully be excluded. We do not guarantee that someone who has obtained a private link will keep it confidential.

10. Changes and contact

These Terms may be updated for future use. Where an applicable version was accepted for a particular event, an update does not silently replace its terms for that event.
